本利用規約（以下「本規約」）は、個人開発者 Rinblog（以下「開発者」）が提供する iOS アプリケーション「たべごよみ」（以下「本アプリ」）の利用条件を定めるものです。本アプリをダウンロード・利用した時点で、本規約に同意したものとみなします。

1. 本アプリの内容

本アプリは、写真から食事を記録し、店に順位をつけ、月ごと・年ごとのまとめ（以下「月報・年報」）を作るためのアプリです。記録はユーザーの端末内に保存され、開発者はこれを預かりません。

記録はユーザーの端末内に保存されます。端末の紛失・故障・初期化、アプリの削除によって記録が失われた場合、開発者はこれを復元できません。本アプリのバックアップ機能を使い、ユーザーご自身で控えを保つことを強くおすすめします。

iCloud への控えは、自動では作られません。設定の「バックアップ」の画面で「今すぐバックアップ」を押したときだけ、記録と写真の複製がユーザー自身の iCloud に保存されます。控えから戻すときは、同じ画面の「バックアップから戻す」を使います。

4. 店の情報について

店の候補は Apple の地図から取得しています。店の名前・位置・営業状況などの正確性について、開発者は保証しません。実際の店の情報は、店または公式の案内でお確かめください。

ユーザーは、本アプリの利用にあたり、次の行為を行ってはなりません。

本アプリおよび本アプリが生成する画面の意匠・文言・図版に関する権利は開発者に帰属します。ユーザーが記録した内容（写真・メモなど）の権利はユーザーに帰属します。ユーザーが本アプリで作った月報・年報の画像を、SNS・ブログなどで自由に共有することを妨げません。

開発者は、本アプリの内容を変更し、または提供を終了することがあります。提供を終了する場合、可能な限り事前にアプリ内またはサポートページでお知らせします。終了後も、ユーザーの端末内の記録と、ユーザー自身の iCloud に作った控えは残ります。

9. 本規約の変更

開発者は本規約を変更することがあります。変更後の内容は本ページに掲示し、掲示の時点から効力を生じます。重要な変更の場合はアプリ内でもお知らせします。

10. 準拠法と管轄

本規約は日本法に準拠します。本アプリに関して紛争が生じた場合、開発者の住所地を管轄する日本の裁判所を第一審の専属的合意管轄裁判所とします。

These Terms of Use (the "Terms") govern your use of the iOS application "Tabegoyomi" (the "App"), provided by the individual developer Rinblog (the "Developer"). By downloading or using the App, you agree to these Terms.

1. What the App is

The App records meals from your photos, ranks the places you eat at, and prints monthly and yearly reports. Your records are stored on your device; the Developer does not hold them.

2. Pricing and subscriptions

The App is free to use. Creating, editing and deleting records, backing them up to iCloud and restoring them, and viewing and sharing the monthly and yearly reports from the month you installed the App onward are free. When you record meals one at a time, you can use photos taken at any time for free.
Free use has these limits. Importing past photos in bulk is limited to photos taken within the last 90 days. Each record can hold up to 2 photos (the first one, plus one more). You can create as many records as you like, and the first photo of every record can always be kept. When you reach the limit, each video ad you watch in full inside the App adds room for one more photo on that record (one photo per ad; the added room stays on that record and does not expire).
The paid plan, "Tabegoyomi Pro" ("Pro"), removes those limits: past photos can be imported whenever they were taken, and there is no limit on the number of photos per record. It also unlocks the medium and large sizes, photo tiles, four looks and Lock Screen versions of the home screen widget; monthly reports for months before you installed the App, and yearly reports for years before you installed it; statistics for past years and for all time; and every report design (the free ones are "Calendar" and "Order slip"). Ads are also removed.
Cancelling never deletes a single record. Your photos, receipts and rankings stay on your device and remain readable at any time, including photos kept beyond the free limit and records imported while you had Pro. Cancelling only removes the Pro features listed above and applies the free limits to what you add from then on. Monthly and yearly reports for the months since you installed the App remain free forever.
Pro is offered as an annual and a monthly plan. Prices shown in the App Store take precedence.
The annual plan includes a free trial. Unless cancelled before the trial ends, the paid period begins automatically.
Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Cancel in Settings › Apple ID › Subscriptions on your iPhone.
Payment is charged to your Apple ID payment method at confirmation of purchase.

3. Storage and backup

Records are stored on your device. If your device is lost, damaged, reset, or the App is deleted, the Developer cannot restore your records. Please keep your own copy using the backup feature in the App.

iCloud backups are never created automatically. Only when you tap "Back up now" on the Backup screen in Settings are your records and the copies of your photos saved to your own iCloud. To bring them back, use "Restore from backup" on the same screen.

4. Place information

Place suggestions come from Apple Maps. The Developer makes no warranty as to the accuracy of place names, locations or business status. Please confirm with the place itself.

5. Prohibited conduct

Anything unlawful or contrary to public order and morals
Disassembling, decompiling or modifying the App, except as permitted by law
Interfering with the operation of the App
Handling photos or information that infringe the rights of others

6. Intellectual property

Rights in the App and in the design, wording and artwork of its screens belong to the Developer. Rights in what you record (photos, notes and so on) remain yours. You are free to share the monthly and yearly reports the App makes for you on social media, blogs, and elsewhere.

7. Disclaimer

The App is provided as is. The Developer does not warrant that it will run without interruption or error.
The Developer is not liable for damages arising from your use of the App, except in cases of wilful misconduct or gross negligence.
Where liability cannot be excluded by law, it is limited to the amount you paid for the App in the preceding 12 months.

8. Changes to, or discontinuation of, the App

The Developer may change the App or stop offering it, giving advance notice in the App or on the support pages where possible. Records on your device, and any backups you have made in your own iCloud, remain yours afterwards.

9. Changes to these Terms

These Terms may change. The revised text is posted on this page and takes effect on posting. Significant changes are also announced in the App.

10. Governing law and jurisdiction

These Terms are governed by the laws of Japan. The court with jurisdiction over the Developer's address shall have exclusive jurisdiction of first instance.
